These terms of service govern your use of the freename.broker website and any brokerage services provided through it. By accessing this website or submitting an inquiry, you agree to these terms. If you do not agree, do not use this website.
1. Who we are
freename.broker is an independent domain brokerage. We are not affiliated with, endorsed by, or connected to Freename.io or any other domain registry, platform, or naming protocol. References to "we", "us" or "our" refer to the operator of freename.broker.
2. Nature of the service
freename.broker provides brokerage services for Freename top-level domain assets. Our services include:
- Valuation of Freename TLDs held by sellers
- Identification and outreach to prospective buyers
- Facilitation and documentation of TLD transfer transactions
We act as an intermediary between sellers and buyers. We are not a party to any transaction between them. All contracts for the sale or purchase of a Freename TLD are entered into directly between the buyer and the seller. We do not hold assets in escrow, take title to any TLD, or guarantee the outcome of any transaction.
3. No guarantee of sale
Engaging freename.broker as your broker does not guarantee that your Freename TLD will sell, or that it will sell at any particular price or within any particular timeframe. We will use reasonable efforts to identify and approach suitable buyers, but the outcome of any brokerage engagement depends on market conditions, buyer interest, and factors outside our control.
4. Seller representations
By submitting a Freename TLD for brokerage consideration, you represent and warrant that:
- You are the lawful owner of the TLD as recorded on the Freename platform
- You have the full right and authority to sell the TLD
- The TLD is free from any encumbrance, dispute, or third-party claim
- The information you provide to us is accurate and complete
We reserve the right to decline to represent any TLD without providing a reason.
5. Fees and brokerage terms
Our brokerage fees are agreed individually for each engagement and communicated to you in writing before any outreach commences. No fee is payable unless and until a transaction closes. The specific terms — including fee structure, fee amount, and payment mechanism — are set out in the brokerage agreement applicable to your engagement.
The initial valuation of your Freename TLD is provided free of charge and carries no obligation to engage our services.
6. Communication
All communication between freename.broker and clients is conducted by email. We do not conduct business by phone, chat, or social media. Email correspondence forms part of the documentary record of any brokerage engagement and may be referenced in the event of a dispute.
7. Confidentiality
We treat all information provided by sellers and buyers as confidential. We do not disclose the identity of our clients, the TLDs we are representing, or the terms of any transaction to third parties, except where necessary to facilitate the transaction with the knowledge and consent of the relevant party, or where required by law.
8. Limitation of liability
To the fullest extent permitted by applicable law, freename.broker shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of this website or our services, including but not limited to loss of profit, loss of data, or failure to complete a transaction.
Our total liability to you in connection with any brokerage engagement shall not exceed the fees paid by you to us in connection with that engagement.
9. No financial or legal advice
Nothing on this website or in our communications constitutes financial, legal, tax, or investment advice. Freename TLDs are a novel asset class and their legal and regulatory treatment varies by jurisdiction. You are responsible for obtaining independent advice before entering into any transaction.
10. Third-party platforms
TLD transfers are executed through the Freename platform. We have no control over and accept no responsibility for the availability, functionality, or terms of the Freename platform or any other third-party service. Any transfer you execute through Freename is subject to Freename's own terms of service.
11. Intellectual property
All content on this website — including text, design, and structure — is the property of freename.broker. You may not reproduce, copy, or redistribute any part of this website without our prior written consent.
12. Changes to these terms
We may update these terms from time to time. The date at the top of this page reflects the most recent revision. Continued use of this website or our services following any update constitutes acceptance of the revised terms.
13. Governing law
These terms are governed by applicable law. Any dispute arising in connection with these terms or our services shall be subject to the exclusive jurisdiction of the courts of the relevant territory, as determined by the operator's country of establishment.
